Google, Viacom: We Won't Settle YouTube Fight Out Of Court

Sumner Redstone 1.jpgWe've always assumed that one day we'd wake up and read that Viacom and Google (GOOG) have settled their YouTube lawsuit. But both companies insist that's not happening.

A day after Sumner Redstone railed against YouTube in aspeech he delivered in Seoul, Google delivers its own retort in the South Korean capital (what's going on in Seoul? A digital forum of some sort):

``Nope,'' David Eun, vice president in charge of content partnerships at Google, told Dow Jones Newswires at a press meeting when asked if Google had any plan to resolve the issue outside court.

``We're going all the way to the Supreme Court,'' Eun said. ``We're very clear about it.''

Call us dreamers, but we still think both sides could kiss and make up before this gets to the Supremes. After all, the two sides were negotiating for months before going hostile. And Sumner Redstone's other media company -- CBS -- seems quite happy with YouTube. So while both sides can argue that there are important principles at play here, we're pretty sure they can get resolved with an appropriately sized check.

Can anyone explain Google's position on this? If I create content, someone (not YouTube) takes it without my consent, then distributes on YouTube, how is YouTube not liable. Isn't that aiding? Is that not what the earlier mp3 P2P sites were accused of? Can someone shed light on what I am missing here?

You are unnecessarily confused. If you photo-copy a book and distribute it to people by mailing over US postal service, then USPS is not responsible for that. The copy-right holder should be suing you and not USPS.

@ Rav - in this case you cannot "police" the copy right violators, so it is up the enabler to police the service. I understand the analogy with the USPS (good one) but the only way possible would be for YouTube to either identify violators, or require authentication before you can upload content, neither will ever happen. So what are the alternatives except for go after YouTube.

@confused - On the contrary its lot easier to police on the internet compared to the other example of USPS. That's what DMCA is about. As per DMCA, the copyright holder has to do the policing and the responsibility of Youtube is to takedown, when sent a notice by copyright holder. In fact Viacom does this all the time and there are specialized companies doing the "policing" for viacom.

The problem on youtube's side is the difficulty in determining what is copyrighted and what is not. Also, another issue is in lot of cases the copyright holders themselves post the stuff on Youtube to reach wider audience. Whatever finger-priting technology that youtube comes up would need co-operation from the copyright holders. I think better digital finger-printing technology is the only solution in this case.

I think the issue for the courts is exactly what you're describing: what is the balance of responsibility for policing infringement.

YouTube is claiming that it's Viacom's job to identify infringing content and Youtube will then comply with any DMCA takedown notifications. Viacom is saying that a greater burden should fall on YouTube, as they are in a better position to monitor each upload, stop repeat offenders, etc. (i.e. Google should put the same effort into fighting stolen content that it does into fighting fraudulent clickers).

The fact that they're willing to "Go to the supreme court" probably implies that illegally posted content is a huge driver of usage, and that they don't want to have to negotiate with content providers for that content.

The court will have to clarify whether Youtube actually is protected by the DMCA. One of the provisions is that the service provider "is not aware of facts or circumstances from which infringing activity is apparent". Erm. What about high view counts? High demand for certain clips might indicate a high quality (and could be seen as fact that an infringing activity is apparent).
In no time I found two clips with 450,000+ views each that apparently are copyright protected. It should not be too difficult to take a look at those clips that drive the most traffic to the site?

I don't see any relation between viewcount and infringing activity. A copyright holder can post a clip that is very popular, in which case there is no infringement. On the other hand, there could be lots of copyrighted clips posted by a non-owner which have very few viewers. In such a scenerio, where same clip can be construed as infringing or not depending on who posted it, I don't see how you can conclude that infringing activity is apparent. If someone posts copyrighted material for which that person has no rights, then it should be that person's responsibility, unless Youtube is actively soliciting copyrighted material. On the contrary youtube makes the users agree that they have the rights to the material that they are posting.

Youtube is actively monitoring their content for adult material and for other violations that are not related to copyright. They have a user-triggered flagging mechanism, and (most likely) a manual review process. So they do have a chance to review clips with a high view count. Viacom may come up with a statistic showing how many views their content had, compared to other, not professionally produced, material on Youtube. Viacom might conclude that a higher viewcount is a good indication for a potential infringement going on (and I agree). If Youtube now monitor clips with high view counts (not an impossible task) and see APPARENT infringements (e.g. a music video with MTV logo, a video with a copyright statement, a well known artist who notified Youtube that their stuff is copyright protected), they are NOT protected by the DMCA any longer.

But probably Viacom will just say that Youtube is not protected by DMCA, because they received 10,000s of takedown notices just from Viacom! This is already a circumstance from which infringing activity is apparent.

My guess: Youtube will have a hard time in court.

Important factors to consider:

YouTube is more or less technically within the law. According to the DMCA, it's the responsibility of the copyright owners to flag infringed content.

There is a writ in the Act that says that if the host is knowledgeable of the posting then the site could be held responsible. BUT. There really isn't a way to prove YouTube's awareness. A large number of views, perhaps, but not until the content owners write a letter are they technically "aware," and it's the responsibility of the site to pull it down.

The real problem here lies in the magnitude. 2 years ago, the number of infringed videos was manageable and could be policed. Today, it takes a crew of 15 working around the clock to keep track of the illegal videos. This is where new legislation or revision of the DMCA comes in.
